This End User License Agreement ("Agreement") is a legal agreement between you ("User", "End-User") and MobilyFlow ("Company", "we", "us") for the use of the Dish To Cart mobile application ("Licensed Application" or "App").
This Agreement is concluded between you and MobilyFlow only — not with Apple Inc. ("Apple") or Google LLC ("Google"). MobilyFlow, not Apple or Google, is solely responsible for the Licensed Application and its content.
By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the App.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded or Android-based device that you own or control, solely for your personal, non-commercial purposes, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions or the Google Play Terms of Service (as applicable). The Licensed Application may also be accessed by other accounts associated with the purchaser via Family Sharing (Apple) or Google Play Family Library, or through volume purchasing programs.
2. Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Attempt to extract the source code of the App
- Remove, alter, or obscure any proprietary notices in the App
- Use the App for any unlawful purpose
- Use automated systems or bots to access the App
3. Account and Data
- The App generates a unique device identifier to associate your data with your device.
- Your data (shopping lists, recipes, categories) is stored locally on your device.
- Premium users may sync data across devices via our servers. You are responsible for maintaining the confidentiality of your device and account.
4. Freemium Model and Subscriptions
The App offers both free and premium features:
- Free tier: 1 shopping list, up to 10 recipes, no multi-device sync.
- Premium tier: Unlimited lists and recipes, multi-device sync.
Premium subscriptions are processed through the Apple App Store or Google Play Store. Billing, renewal, and cancellation are governed by the respective store's terms. We do not directly process payments.
5. Maintenance and Support
MobilyFlow is solely responsible for providing maintenance and support services for the Licensed Application, as specified in this Agreement or as required under applicable law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

6. Intellectual Property
The App and all related content, features, and functionality are owned by MobilyFlow and are protected by international copyright, trademark, and other intellectual property laws. This Agreement does not transfer any ownership rights to you.
In the event of any third-party claim that the Licensed Application, or your possession and use of the Licensed Application, infringes that third party's intellectual property rights, MobilyFlow — not Apple or Google — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Warranty
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, to the extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may:
- Apple App Store: Notify Apple, and Apple will refund the purchase price for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application.
- Google Play Store: Request a refund in accordance with Google Play's refund policies.
Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are MobilyFlow's sole responsibility.
8. Product Claims
You acknowledge that MobilyFlow, not Apple or Google, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:
- Product liability claims
- Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation
9. Limitation of Liability
To the maximum extent permitted by applicable law, MobilyFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the App. Nothing in this Agreement limits MobilyFlow's liability to the End-User beyond what is permitted by applicable law.
10. Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country.
- You are not listed on any U.S. Government list of prohibited or restricted parties.
11. Third-Party Terms
When using the Licensed Application, you must comply with all applicable third-party terms of agreement, including but not limited to your wireless data service agreement and the terms of service of any third-party services accessed through the App.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of this Agreement. Upon termination, your license to use the App is immediately revoked.
13. Third-Party Beneficiaries
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement when the Licensed Application is obtained through the Apple App Store. Upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
14. Changes to This Agreement
We reserve the right to modify this Agreement at any time. Updated terms will be posted within the App or on our website. Continued use of the App after changes constitutes acceptance of the new terms.
15. Governing Law
This Agreement is governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
